1. Scope of Application

These GTC apply to all contracts concluded between Wave Hotel Potsdam Immobilien Verwaltung GmbH (hereinafter referred to as “Hotel”) and the guest (hereinafter referred to as “Customer”). They apply to all bookings and services offered by the Hotel to its customers in connection with their stay or use of the facilities. Subletting or transferring the room or hotel premises for purposes other than accommodation requires the prior written consent of the Hotel.

2. Conclusion of Contract

The accommodation contract between the Hotel and the Customer is concluded upon the Customer’s booking request and the subsequent written booking confirmation from the Hotel, provided that the requested room is available.

3. Services and Prices

The services and prices of the Hotel are based on the current price lists and offers made available to the Customer prior to booking. The Hotel’s prices apply to the agreed services. The Hotel reserves the right to change prices if tax rates, fees, or levies are modified and the Hotel is affected by these changes. In contracts with consumers, this applies only if more than four months have passed between the conclusion of the contract and its adjustment. Price changes may also occur if the Customer’s stay is extended, shortened, or additional services are used.

4. Payment Terms

The total accommodation price agreed upon at the time of booking must be paid at the latest upon arrival at the Hotel. The following payment methods are accepted: cash in euros, EC card (Girocard), MasterCard, Visa, and American Express. When using the self-check-in terminal at the Hotel, cash payment is not possible. Advance payment via bank transfer to a bank account specified by the Hotel during booking is permitted, provided that the payment is received before arrival. For credit card payments, the card must be issued in the name of the Customer. Offsetting by the guest is excluded unless the offset relates to an undisputed or legally established claim.

5. Cancellation of Booking

The Customer may cancel the confirmed booking in accordance with the applicable cancellation policy. Different cancellation policies apply depending on the booked rate. The specific cancellation terms, including deadlines and potential fees, are communicated to the Customer before booking and depend on the type of rate booked. In case of cancellation, the fee will be calculated according to the specific conditions of the booked rate. For “non-cancellable” rates, cancellation may be excluded. If cancellation is excluded or the cancellation is made after the deadline, the Hotel retains the right to the agreed payment. The same applies if the Customer does not arrive to use the booked room(s) (“No Show”). In this case, the Hotel retains the right to payment minus any savings due to the no-show.

6. Hotel's Right of Withdrawal

The Hotel may withdraw from the contract under the following conditions:

  • The Customer fails to make payment on time or does not pay upon arrival.
  • Force majeure or unforeseen events make the fulfillment of the contract impossible.
  • The Customer provides false information during booking or violates the Hotel’s house rules.
  • The Hotel has reason to believe that the stay may endanger the Hotel’s business operations, safety, or public reputation, due to illegal actions or use of the room for purposes other than accommodation.
  • If the Customer is entitled to withdraw within a specified period, the Hotel may also withdraw. In such cases, the Hotel will promptly notify the Customer in writing and terminate the contract.

7. Provision, Handover, and Return of Rooms

Rooms are available from 3:00 PM on the agreed arrival date and must be vacated by 11:00 AM on the departure date. If the room is not vacated by 11:00 AM, the Hotel may charge 50% of the overnight rate. If the room is not vacated by 4:00 PM, the full overnight rate may be charged.

8. Hotel’s Liability

The Hotel is liable for damages resulting from injury to life, body, or health only if it is responsible for such damages. It is also liable for other damages only if caused intentionally or through gross negligence or the breach of contractual obligations. The Hotel is liable for items brought in according to statutory provisions and recommends using the hotel or room safe for valuables. Items exceeding EUR 800 in value (cash, valuables, etc.) or other items exceeding EUR 3,500 require a separate agreement before being brought in. In the event of defects or disruptions related to the contractual relationship, the Hotel will take reasonable measures to remedy the issue once it becomes aware of it. The Customer is required to contribute to resolving the issue and minimizing potential damage. The Hotel accepts no liability for damages resulting from the use of the public parking garage at Schiffbauergasse 14, 14467 Potsdam, even if used with a hotel parking card. No storage contract is concluded in this case.

9. Pets

Dogs are welcome in the Hotel and in guest rooms. A fee of EUR 20 per dog and night applies. Dogs are not allowed on beds or upholstered furniture. A maximum of two dogs per room is permitted, additional dogs only upon prior request and approval. Pets other than dogs are not allowed unless explicitly approved before booking. The Hotel reserves the right to reject a pet at any time if it disturbs other guests. Pets must be healthy, pose no danger to guests or staff, and remain under the Customer’s supervision at all times.

10. Non-Smoking Policy

Smoking is prohibited in all areas of the Hotel. In case of violation, a cleaning fee of EUR 50 will be charged. This includes any loss of revenue due to the room being unrentable. If the actual damage is demonstrably higher or lower than EUR 50, the proven amount shall apply.

11. Final Provisions

Changes or additions to the accommodation contract, these GTC, or the booking confirmation must be made in writing. Unilateral amendments are invalid. German law applies. The application of the UN Sales Convention is excluded. All claims against the Hotel expire one year after the legal limitation period begins, unless related to injury to life, body, or health, or caused by gross negligence or intent. Jurisdiction is Potsdam if the Customer is a merchant, a legal entity under public law, or a special fund under public law. Otherwise, legal jurisdiction rules apply. The European Union provides an online platform for out-of-court dispute resolution. The Hotel does not participate in consumer arbitration procedures.
